10. Flat Fee Service Explanation

National Home Realty's $6,000 Flat Fee Service: When we reference "$6,000 flat fee" or "$6K flat fee" throughout our website and marketing materials, this refers to our listing fee for seller representation services only.

Fee Structure: The flat fee of $6,000 is exclusive of applicable taxes. The total amount payable is $6,000 plus Harmonized Sales Tax (HST) at the current rate of 13%, resulting in a total of $6,780. This fee is payable only upon successful completion of the sale of your property.

Seller Representation Only: The $6,000 flat fee applies exclusively to seller representation services provided by National Home Realty. This fee covers our services as the listing brokerage, including MLS® listing, professional photography, marketing coordination, negotiation support, and transaction management for the sale of your property.

Buyer Representation Separate: The $6,000 flat fee does not apply to buyer representation services. When National Home Realty acts as a buyer's agent, separate commission arrangements apply as negotiated between the buyer and National Home Realty, typically funded through the commission offered by the seller's listing brokerage in accordance with standard real estate practices.

Buyer's Agent Commission: As the seller, you may choose to offer a commission to the buyer's agent (typically 2-2.5% of the sale price). This commission is separate from our $6,000 flat listing fee and is paid directly to the buyer's brokerage. This commission structure helps ensure maximum exposure for your property to all potential buyers represented by various brokerages.

No Hidden Fees: Our $6,000 flat fee (plus HST) is the total amount you pay for our seller representation services. There are no additional listing fees, marketing fees, or transaction fees. Fully open contracts are for listing agreements, unless otherwise specified on a buyer/seller representation agreement.

11. MLS® Access and Data Usage

MLS® Data Display: National Home Realty displays property listings from the Multiple Listing Service® (MLS®) on our website for informational purposes. This data is provided through our membership with the Toronto Regional Real Estate Board (TRREB) and is subject to the rules and regulations of the Canadian Real Estate Association (CREA) and TRREB.

Data Accuracy: While we strive to ensure the accuracy of MLS® data displayed on our website, all information is provided "as is" without warranty. Property information, including prices, availability, and specifications, may change without notice. We recommend verifying all information directly with the listing brokerage or through your own due diligence.

MLS® Trademark: The trademarks MLS®, Multiple Listing Service®, and the associated logos are owned by CREA and identify the quality of services provided by real estate professionals who are members of CREA. National Home Realty uses these marks under license.

User Restrictions: MLS® data displayed on our website is intended for personal, non-commercial use by consumers with a bona fide interest in the purchase, sale, or lease of real estate. This information may not be used for any commercial purpose or republished without authorization.

Third-Party Listings: Our website may display listings from other brokerages. We are not responsible for the accuracy of information provided by other brokerages, and any inquiries about specific listings should be directed to the listing brokerage.

12. Buyer Cash Back and Rebate Programs - OREA Compliance

Legal Framework: National Home Realty's buyer cash back and rebate programs are fully compliant with the rules and regulations established by the Ontario Real Estate Association (OREA) and the Real Estate Council of Ontario (RECO).

Commission Rebates: Under OREA guidelines, registered real estate brokerages and salespersons may offer to rebate a portion of the commission they receive from a transaction back to their client, provided such arrangements are:

  • Disclosed in writing to all parties involved in the transaction
  • Properly documented in the buyer representation agreement
  • Compliant with RECO's Code of Ethics and Standards of Practice
  • Not misleading or deceptive in nature

Transparency Requirements: All rebate amounts, terms, and conditions are clearly disclosed in our buyer representation agreements. Rebates are calculated based on the commission received by National Home Realty from the seller's listing brokerage and are subject to the terms agreed upon in writing.

Rebate Payment: Buyer rebates are paid at closing, directly to the buyer, and are properly documented on the closing statement. Rebate amounts vary based on the purchase price, commission structure, and the specific terms of the buyer representation agreement.

No Guarantees: Rebate amounts are not guaranteed and may vary based on factors including but not limited to: the commission structure offered by the seller's listing brokerage, the purchase price, the speed at which a property is found, and the terms negotiated in the buyer representation agreement.

Professional Standards: National Home Realty maintains the same professional standards and fiduciary duties to buyers regardless of rebate arrangements. Our rebate programs do not affect the quality of service, representation, or professional obligations we owe to our clients.

13. National Home Realty Buyer Cash Back Program – Terms & Conditions

1. Eligibility

The National Home Realty Buyer Cash Back Program ("Program") is available to eligible buyers who purchase a property through National Home Realty and successfully complete the transaction. Buyer Cash Back is payable only after the transaction has successfully closed and National Home Realty has received the cooperating commission.

2. Buyer Cash Back Schedule

The Buyer Cash Back timeline begins on the Commencement Date (defined below).

The applicable Buyer Cash Back amount is determined by the date the buyer's offer is first submitted, measured from the Commencement Date.

Offer Submitted After Commencement Date Buyer Cash Back
Days 1–7 50% Buyer Cash Back
Days 8–14 35% Buyer Cash Back
Days 15–21 25% Buyer Cash Back

After day 21, the Buyer Cash Back amount is set out in your written agreement with National Home Realty. Percentage rebates are calculated on the cooperating commission actually received by National Home Realty upon the successful completion of the transaction.

3. Commencement Date

The Commencement Date is the earliest occurrence of either of the following:

  • A National Home Realty sales representative conducts the buyer's first in-person or virtual property showing; or
  • A National Home Realty sales representative prepares or submits the buyer's first Agreement of Purchase and Sale (Offer) if no property has previously been shown.

The Buyer Cash Back timeline starts on whichever of these events occurs first.

The Commencement Date is established only once and remains in effect throughout the buyer's representation with National Home Realty.

4. Determination of Buyer Cash Back

Although the Buyer Cash Back timeline begins on the Commencement Date, the applicable Buyer Cash Back amount is determined by the date the buyer's offer is first submitted, measured from the Commencement Date.

Once an offer is submitted within a qualifying Buyer Cash Back period, that Buyer Cash Back amount is locked in for that transaction.

The Buyer Cash Back amount will not be reduced because:

  • negotiations continue beyond the applicable rebate period;
  • counter-offers are exchanged;
  • amendments are signed;
  • acceptance occurs after the applicable rebate period expires; or
  • additional time is required to reach a final agreement.

Example 1

A buyer's first property showing occurs on June 1. The Buyer Cash Back timeline begins on June 1. The buyer submits an offer on Day 6 and, after several rounds of negotiations, the offer is accepted on Day 9. The buyer remains eligible for the 50% Buyer Cash Back because the offer was submitted within Days 1–7.

Example 2

A buyer's first property showing occurs on June 1. The buyer does not submit an offer until Day 16. The buyer qualifies for the 25% Buyer Cash Back because the offer was submitted during Days 15–21.

5. Unsuccessful Offers

If an offer:

  • expires;
  • is rejected;
  • is withdrawn;
  • is terminated;
  • becomes null and void;
  • fails to satisfy conditions; or
  • otherwise does not result in a completed purchase,

the Buyer Cash Back timeline does not restart.

The original Commencement Date remains in effect.

Any subsequent offer submitted on the same property or on a different property is considered a continuation of the buyer's original representation and does not establish a new Buyer Cash Back period.

6. Multiple Properties

The Buyer Cash Back Program applies to the buyer's representation as a whole and not to individual properties.

Viewing additional properties, changing search criteria, submitting offers on multiple properties, purchasing a different property, or temporarily pausing a home search does not restart, suspend, extend, or otherwise affect the Buyer Cash Back timeline.

7. Exclusive Representation

The Buyer Cash Back Program is available only where National Home Realty is the procuring cause of the purchase.

Buyers who purchase a property through another brokerage, salesperson, builder, directly from a seller, or otherwise outside of National Home Realty's representation are not eligible for Buyer Cash Back under this Program.

8. Closing Required

Buyer Cash Back is payable only after:

  • the transaction successfully closes;
  • legal title transfers to the buyer; and
  • National Home Realty receives the cooperating commission.

If the transaction fails to close for any reason, no Buyer Cash Back is payable.

9. Commission Received

Percentage rebates are calculated solely on the commission actually received by National Home Realty.

If the cooperating commission offered by the listing brokerage is reduced, negotiated, adjusted, or otherwise differs from the anticipated commission, the Buyer Cash Back rebate will be calculated using the commission actually received.

10. Non-Transferable

Buyer Cash Back:

  • is non-transferable;
  • cannot be assigned to another purchaser;
  • has no cash value until the transaction has closed; and
  • cannot be combined with any other National Home Realty promotion unless approved in writing.

11. Program Changes

National Home Realty reserves the right to modify, suspend, or discontinue the Buyer Cash Back Program for future transactions at any time, subject to applicable law. Changes will not affect transactions already in progress where eligibility has been established.

12. Compliance with Applicable Law

This Program is subject to all applicable federal, provincial, and municipal laws, including the Trust in Real Estate Services Act, 2002 (Ontario), its regulations, and the rules of the applicable real estate regulator.

13. Final Interpretation

Participation in the Buyer Cash Back Program constitutes acceptance of these Terms & Conditions.

National Home Realty reserves the right to interpret and administer these Terms & Conditions reasonably and in accordance with applicable law. Any questions regarding eligibility should be directed to National Home Realty before viewing properties or submitting an offer.

14. OREA Rules on Buyer and Seller Representation

Dual Agency Disclosure: National Home Realty operates in compliance with OREA and RECO regulations regarding buyer and seller representation. In accordance with these rules:

  • Separate Representation: When National Home Realty represents a seller and a different buyer (represented by another agent or brokerage), each party receives independent representation with full fiduciary duties.
  • Same Brokerage Representation: If National Home Realty represents both the buyer and seller in the same transaction, we must obtain written consent from both parties and clearly explain the implications of this arrangement, including any limitations on representation.
  • Fiduciary Duties: Whether acting as a buyer's agent or seller's agent, National Home Realty owes fiduciary duties including: loyalty, confidentiality, disclosure, obedience, reasonable care, and accounting. These duties are maintained regardless of fee structure.
  • Conflict of Interest: We are required to disclose any actual or potential conflicts of interest and obtain informed consent before proceeding with representation.

Commission Structure: OREA rules require that all commission arrangements be disclosed in writing. Our $6,000 flat fee applies to seller representation only. Buyer representation commissions are separate and are typically funded through the commission offered by the seller's listing brokerage, as disclosed in the listing agreement.

Written Agreements: All representation relationships are documented in written agreements (listing agreements for sellers, buyer representation agreements for buyers) that clearly outline services, fees, commission structures, and the rights and obligations of all parties.

Professional Standards: National Home Realty and all affiliated salespersons are licensed by RECO and are bound by the Code of Ethics and Standards of Practice, which require honesty, integrity, competence, and professional service regardless of fee structure or commission arrangements.

Complaint Process: If you have concerns about our representation or compliance with OREA/RECO rules, you may file a complaint with RECO. Information about the complaint process is available at www.reco.on.ca.
